Please Note:
Any requests for payment of monies for the benefit of the child before their 18th birthday, or for the patient at any stage, must be made directly to the local Court responsible for administering the fund, the address for which you can find on the HMCS website.
Our role is merely as the bank operating on behalf of the court and hence can only act upon court instructions.
The Court Funds Office (CFO) provides a banking and administration service for the courts throughout England and Wales, including the High Court. We account for money being paid into and out of court and, as directed by the court, look after any investments made with that money. The Accountant General of the Senior Courts is responsible for the proper control of all money paid into court. Our clients are people who have money ‘held in court’. These can be:
- Children awarded damages as a result of civil legal action in a county court in England or Wales or the High Court of Justice
- Clients who lack the capacity to manage their financial affairs, thus leading to the Court of Protection appointing a Deputy to legally act on their behalf
- Cases where money is held in court pending settlement of civil court action, dissenting shareholders, widows, and other clients whose funds are held under a variety of different statutes
Our work is governed by the Civil Procedure Rules and Court Funds Rules, which gives us the authority to accept and hold payments into court until we are instructed to pay them out.
The Court Funds Office is unable to provide copies of statements to our clients between 1st of March and 5th of April.
This is so that we can update our system and ensure that statements for the tax period 2007/08 are complete.

Important Information
The Court Funds Office no longer accept payments in satisfaction of a claim following the changes to Part 36 of the Civil Procedure Rules that came into effect on the 6th April. Part 36 amendments remove the requirement for defendants to make an offer to settle money claims in the form of a payment into court.
