Disputes between or with trustees

The Official Solicitor can be appointed to be an impartial trustee when the original trustees and/or beneficiaries are unable to reach agreement as to the administration of the trust.

Where disagreement hinders the administration of a trust to the extent that decisions cannot be made, the Official Solicitor may be appointed under s.36 of the Trustee Act or Judicial Trustees Act 1896.

He will only accept appointment where at least one of the affected beneficiaries lacks mental capacity and/or is vulnerable.
