Dissolution of marriage and civil partnerships
The Official Solicitor may act for mentally incapable petitioners or respondents to petitions for divorce, nullity of marriage, judicial separation or for the dissolution or nullity of civil partnership or separation. This is because the court has to be satisfied that their interests are properly protected, both in the main proceedings and in related disputes over financial provision and care of the children.
The involvement of the Court of Protection may be required during the course of the proceedings or to assist with the carrying into effect of a final order made in the proceedings.
